If you are involved in an accident and desire to plead NOT GUILTY and have your case heard on the date set, please notify the court within seven (7) calendar days from the date the summons was issued. If this notice is not received by the court and the officer needs witnesses for the trial, the case may have to be continued from the original court date. You are still required to appear on the original court date whether you send this form or not unless you have received official notice from the court that the case has been continued to a future date or unless you decide to plead guilty and prepay the offense. Failure to appear may result in your being tried in your absence.

Please visit the Virginia Courts Case Information web site and select Fauquier from the drop-down list. Follow the directions on the screen to determine if your fine is prepayable. If your summons is prepayable AND has a valid code section (verify via the web site) written by the officers, the General District Court is able to take a prepayment on the case until 3:30 PM the business day prior to the court date.

If you fail to appear in court, you may be convicted in absence, issued a higher fine, and possibly have your license suspended. There will also be a trial in absence fee. Failure to pay will result in license suspension.
